Terms and Conditions

1. Agreement

These Terms and Conditions (“Terms”) govern your use of Mosey Mate, including its mobile application and related website, provided by Oh Rover LLC (“Oh Rover,” “we,” “us,” or “our”). By downloading, accessing, or using Mosey Mate, you agree to these Terms. If you do not agree, do not use the app.

2. Eligibility and Your Responsibilities

You may use Mosey Mate only if you are legally able to enter into these Terms. If you are a minor, use the app with the involvement and permission of a parent or legal guardian where required. You are responsible for your device, app-store account, and compliance with laws that apply to you.

Do not misuse the app, interfere with its operation, attempt unauthorized access, reverse engineer it except where applicable law permits, or use it to violate another person’s rights.

3. Health and Walking Disclaimer

Mosey Mate is a motivation and entertainment app, not a medical device, healthcare service, fitness professional, or source of medical advice. Step counts and other app calculations may be incomplete or inaccurate because they depend on your device and authorized health platforms. Do not use Mosey Mate to diagnose, treat, or prevent a medical condition. Consult a qualified healthcare professional before changing your activity, especially if you have a health concern.

Walk only when and where it is safe. Pay attention to traffic, terrain, weather, your surroundings, and your own limits. You are solely responsible for deciding whether and how to walk.

4. Privacy

Our Privacy Policy explains what Mosey Mate accesses and how information is handled. In general, the app is designed to keep app and step data on your device and does not use ads, analytics, or behavioral tracking.

5. Purchases and Subscriptions

Mosey Mate may offer optional subscriptions or one-time in-app purchases. Prices, billing period, benefits, and any introductory offer will be shown in the app-store purchase flow before you buy. Purchases are processed by Apple or Google, not directly by Oh Rover.

Subscriptions may renew automatically unless you cancel through the Apple App Store or Google Play before the renewal date. Deleting the app does not necessarily cancel a subscription. Cancellation, refunds, taxes, payment methods, and purchase records are subject to the applicable app store’s terms and policies, as well as applicable law. We use RevenueCat to help communicate purchase and entitlement status between Mosey Mate and the app stores.

To restore an eligible purchase, use the Restore Purchases feature in Mosey Mate. Access to purchased features may depend on a valid app-store transaction and the availability of the relevant app version or feature.

6. License

Subject to these Terms, Oh Rover grants you a limited, personal, non-exclusive, non-transferable, revocable license to use Mosey Mate for your personal, non-commercial use on a device you own or control. The app and its content, including its software, artwork, names, text, and designs, belong to Oh Rover or its licensors and are protected by intellectual-property laws.

7. Availability and Changes

We may modify, suspend, or discontinue all or part of Mosey Mate, including features and content, at any time. We do not guarantee that the app will always be available, error-free, compatible with every device, or preserve every locally stored item after an update, device change, or operating-system change. We may update these Terms from time to time. The revised version will be posted here with a new effective date; continued use after the update means you accept the revised Terms to the extent permitted by law.

8. Disclaimers

To the maximum extent permitted by law, Mosey Mate is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or uninterrupted operation. Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.

9. Limitation of Liability

To the maximum extent permitted by law, Oh Rover and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or use, arising from or related to Mosey Mate or these Terms. To the maximum extent permitted by law, our total liability for claims related to Mosey Mate will not exceed the greater of the amount you paid to us for the app or in-app purchases during the twelve months before the event giving rise to the claim, or one hundred U.S. dollars. Nothing in these Terms limits liability that cannot legally be limited.

10. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Oh Rover and its affiliates, personnel, licensors, and service providers from claims, damages, liabilities, costs, and expenses arising from your misuse of Mosey Mate, your violation of these Terms, or your violation of another person’s rights.

11. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where Oh Rover LLC is organized, without regard to conflict-of-law rules, except where applicable consumer-protection law requires otherwise. Any dispute will be handled in a court with appropriate jurisdiction, unless applicable law gives you another forum or requires a different process.
